Lawyers for a Fort Stewart soldier are asking a federal judge to stop the Army from transferring him to Kuwait to face a court-martial on charges that the soldier made threats in an angry hip-hop song he recorded.

Lawyers for Spc. Marc Hall say moving the case overseas would violate his right to a fair trial.

Hall's attorneys filed a motion Monday in U.S. District Court in Savannah asking a judge to force the military to keep the
court-martial in the U.S.

Hall, of Coward, S.C., has been jailed since December on charges that he made threats in conversation with fellow soldiers and in
his song "Stop Loss."

The Army says it wants to move Hall's trial because prosecution witnesses in his unit are now in Iraq.
